These Website Terms and Conditions of Use (Terms of Use) apply to the website operated by or on behalf of SAC Health (SAC Health), including but not limited to the website located at https://www.sachealth.org (individually and collectively, the Site). By accessing or using the Site, you agree to comply with and be bound by these Terms of Use. Please read these Terms of Use carefully before accessing or using the Site.

User Obligations. Limitation of Liability. Indemnification. Term and Termination. These Terms of Use will take effect at the time you begin using the Site. SAC Health reserves the right, with or without notice, at any time and for any reason to deny you access to Site or to any portion thereof, and to terminate these Terms of Use or any portion thereof. These Terms of Use will terminate automatically if you fail to comply with or violate them. Upon any termination of these Terms of Use, all rights and licenses granted to you under section 1 shall terminate, and you must destroy all materials obtained from the SAC Health website and all copies thereof. Governing Law. All matters relating to your access to or use of the Site, including all disputes, will be governed by and construed in accordance with the laws of the State of California, without regard to any conflicts-of-laws principles.

Arbitration. Any controversy or claim (Claim) you have arising out of or relating to these Terms of Use and/or your use the Site shall be resolved by a single impartial arbitrator pursuant to proceedings administered by the American Arbitration Association under its rules for resolution of commercial disputes. Any such Claim shall be brought, in any arbitration or other legal proceeding, solely by you as an individual and not as part of, or as a representative of, a class.

Jurisdiction; Venue. You hereby irrevocably consent to the exclusive jurisdiction of the state courts located in San Bernardino County, California, USA, and the federal courts located in Riverside and Los Angeles Counties, California, in all disputes arising out of or related to your access to or use of the Site and/or these Terms of Use. EACH PARTY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING.

Severability. If any provision of these Terms of Use, or part thereof, is held to be illegal, invalid or unenforceable by a court of competent jurisdiction, or in an arbitration proceeding involving you and SAC Health, then the unlawful, invalid, or unenforceable portion(s) shall be deemed to be severed from these Terms of Use, and such determination shall not affect the lawfulness, validity, and enforceability of the remaining provisions or parts thereof.
